JOIC to pursue legal action for failure to pay registration fee

The Jersey Office of the Information Commissioner (JOIC) has today confirmed that it will be commencing formal legal proceedings against a number of data controllers for non-compliance with their legal obligation to register and pay the annual data protection fee, as required under the Data Protection Authority (Jersey) Law 2018 and the Data Protection (Registration and Charges) (Jersey) Regulations 2018.

This action follows a period of engagement by JOIC to encourage compliance through direct communication and reminders. Despite these efforts, a number of organisations (sole-traders and companies) have remained persistently non-compliant and failed to pay the mandatory annual fee and a letter will shortly be sent to those organisations as a first step in a formal debt recovery process.
